1. Agreement to Terms
By accessing and using the Petals & Pines website and services, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services.
2. Services Overview
Petals & Pines provides floral arrangement services, including custom bouquets, event florals, and flower delivery within the Vancouver area. Our services are subject to availability and may be modified or discontinued at any time without notice.
3. Orders and Payments
3.1 Placing Orders
Orders can be placed through our contact form, by phone, or in person at our shop. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing, or suspected fraudulent activity.
3.2 Pricing
All prices are listed in Canadian Dollars (CAD) and are subject to change without notice. We strive to display accurate pricing, but errors may occur. If we discover a pricing error after you've placed an order, we will notify you and give you the option to confirm the order at the correct price or cancel it.
3.3 Payment
Payment is required at the time of order placement. We accept major credit cards, debit cards, and other payment methods as indicated. All payments are processed securely through trusted third-party payment processors.
3.4 Taxes
All applicable federal and provincial taxes (including GST/HST) will be added to your order total as required by Canadian law.
4. Delivery
4.1 Delivery Area
We deliver within the Greater Vancouver area. Delivery fees vary based on location and are calculated at the time of order. Specific delivery areas and fees will be communicated when you place your order.
4.2 Delivery Times
We will make every effort to deliver your order at the requested time. However, delivery times are estimates and not guaranteed. Factors beyond our control (such as traffic, weather, or recipient availability) may affect delivery times.
4.3 Recipient Availability
If the recipient is not available at the delivery address, we will attempt to contact them or leave the arrangement in a safe location. We are not responsible for arrangements left with neighbors, building concierges, or in safe locations once delivery is complete.
4.4 Delivery Refusals
If a recipient refuses delivery, the customer will be responsible for additional charges if re-delivery is requested. Refunds will not be provided for refused deliveries unless there is a quality issue with the arrangement.
5. Product Information
5.1 Flower Substitutions
We work with natural, seasonal products. While we strive to fulfill orders as pictured or described, we reserve the right to substitute flowers or materials of equal or greater value if the specified items are unavailable. We will maintain the style, color scheme, and overall design of the arrangement.
5.2 Product Images
Images on our website are for illustrative purposes only. Actual arrangements may vary in exact appearance due to the natural variation of flowers and seasonal availability.
5.3 Vases and Containers
Unless specified otherwise, arrangements are delivered in vases or containers suitable for the design. Containers may vary based on availability while maintaining the aesthetic of the arrangement.
6. Cancellations and Refunds
6.1 Cancellations
Orders may be cancelled up to 24 hours before the scheduled delivery or pickup time for a full refund. Cancellations made less than 24 hours before delivery may be subject to a cancellation fee. Same-day orders cannot be cancelled once confirmed.
6.2 Refund Policy
If you are not satisfied with your order, please contact us within 24 hours of delivery. We will work with you to resolve the issue, which may include:
- Replacing the arrangement at no additional charge
- Providing a partial refund
- Issuing store credit for future purchases
Refunds will be processed using the original payment method within 5-10 business days of approval.
6.3 Quality Guarantee
We guarantee the freshness and quality of our flowers. If you receive an arrangement that does not meet our quality standards, please contact us immediately with photographic evidence, and we will arrange for a replacement or refund.
7. Customer Responsibilities
As a customer, you agree to:
- Provide accurate delivery information (address, contact details, special instructions)
- Ensure someone is available to receive deliveries when scheduled
- Provide accurate payment information
- Notify us immediately of any issues with your order
- Follow care instructions to maintain flower freshness
8. Liability Limitations
8.1 Service Limitations
Petals & Pines is not responsible for:
- Delays caused by incorrect delivery information provided by the customer
- Deliveries to incorrect addresses due to customer error
- Damage to arrangements after delivery is complete
- Recipient reactions or allergies to flowers
- Weather-related delays or cancellations
- Circumstances beyond our reasonable control (force majeure events)
8.2 Maximum Liability
Our liability for any claim related to our services shall not exceed the purchase price of the specific order in question. We are not liable for any indirect, incidental, special, or consequential damages.
9. Intellectual Property
All content on the Petals & Pines website, including text, images, logos, and designs, is the property of Petals & Pines or its content suppliers and is protected by Canadian and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without written permission.
10. Privacy
Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
11. Special Occasion Orders
11.1 Weddings and Events
Wedding and event orders require a consultation and signed contract with specific terms. These orders are subject to separate terms and conditions outlined in the event contract.
11.2 Holiday Orders
During peak holidays (Valentine's Day, Mother's Day, Christmas, etc.), special ordering and delivery policies may apply. We will communicate these policies in advance.
12. Allergies and Safety
Some flowers and plants may cause allergic reactions or be toxic to pets. It is the customer's responsibility to inform themselves about potential allergens and keep arrangements away from pets and children if necessary. We are not liable for allergic reactions or pet/child safety issues related to our products.
13. Website Use
13.1 Acceptable Use
You agree to use our website only for lawful purposes. You must not use our website:
- In any way that violates Canadian laws or regulations
- To transmit or distribute viruses or malicious code
- To harass, abuse, or harm others
- To collect user information without consent
- To attempt unauthorized access to our systems
